LEGAL TERMS & CONDITIONS

1. Risk Acknowledgement

I acknowledge that bouldering and related activities are classified as Dangerous Recreational Activities under Australian Consumer Law. Risks include uncontrolled falls, collision with walls/holds/people, fractures, sprains, hyperextension, cuts, cardiovascular events, panic attacks, and in rare cases serious permanent injury or death. I have been sufficiently advised of these risks and voluntarily assume them.

2. Release & Indemnity

To the maximum extent permitted by law, I release and indemnify Wall Walkers Pty Ltd (the "Company"), its directors, employees, agents, and premises owners from liability for personal injury, death, or property damage arising from my participation, including liability arising from negligence, breach of contract, or breach of statutory warranties under the Competition and Consumer Act 2010 (Cth). This release does not extend to gross negligence, intentional misconduct, or fraud.

3. Health & Conduct

I warrant I am physically capable of participating safely. I will disclose any relevant medical conditions, comply with staff instructions and facility rules, and not engage in activities for which I am not trained. I accept responsibility for health incidents arising from pre-existing conditions. The Company may revoke my access for unsafe behaviour without refund.

4. 24-Hour Access (if applicable)

During unstaffed hours: I accept additional risks including no supervision, potential delayed emergency response, and reduced lighting. I will wear the duress button when alone, not grant access to others (including tailgating), keep credentials secure, and familiarise myself with emergency procedures. In emergencies, I or others present must call 000 and report incidents to the Company. Persons under 16 must be accompanied by a parent/guardian during unstaffed hours. I authorise the Company to arrange emergency medical treatment if I am incapacitated.

5. Video Induction

I confirm I have watched the mandatory safety induction video(s) in full and understood the content including: safe falling techniques, equipment use, fall zone awareness, height limits, and emergency procedures. I agree to view any updated content as required.

6. General Provisions

I consent to CCTV surveillance in public areas for safety/security, and to use of my image in promotional materials. The Company is not responsible for lost/stolen property. This agreement is ongoing, governed by Queensland law, and binding on my heirs and assigns. If any provision is unenforceable, it shall be read down to the extent necessary. I agree to pay applicable fees as advertised.

7. Minors

If signing for a person under 18, I confirm I am their parent/legal guardian, authorised to bind them to these terms. I accept full responsibility for the minor's safety and behaviour.
